In the administrative, SafeRoads regime, it includes the documents submitted by the police that outline the basis for issuing the Notice of Administrative Penalty. Disclosure is often much more fulsome in the criminal context and normally includes the police officer’s handwritten notes and reports, any witness statements, any collision reports, the Intoxilyzer printout etc. Disclosure also sometimes includes videotapes, audiotapes and photos. In the SafeRoads Administrative regime, disclosure often is limited to some notes and reports and pictures of the screening devices.
